The short answer
Yes, people file EB-2 NIW petitions without publications and without a PhD. Neither is a legal requirement. What you must show is EB-2 eligibility plus the three Dhanasar prongs. Without papers and citations, the evidence has to come from somewhere else: projects with measurable results, adoption of your work, patents in use, products, leadership, and independent people who can say what your work changed.
That does not make anyone eligible automatically. The bar is the same for everyone; only the type of evidence changes.
What you still need: EB-2 eligibility
The waiver only removes the job offer and labor certification. You still must qualify for EB-2 under 8 CFR 204.5(k), in one of two ways.
- An advanced degree: a U.S. master's or higher, or a foreign equivalent, or a U.S. bachelor's (or foreign equivalent) followed by at least five years of progressive experience in the specialty.
- Exceptional ability: expertise significantly above what is ordinarily found in the sciences, arts or business, shown by at least three of the six types of evidence the regulation lists, and then by the record as a whole.
Professional success is not the same as national importance
A high salary, a strong title or a successful employer shows you are good at your job. Prong 1 asks something different: whether your proposed endeavor has national importance, meaning broader effects beyond one employer or its clients. Make sure your evidence connects your work to a wider impact, such as a field, an industry, public health, infrastructure or a region's economy.
Evidence that can replace publications
Projects with measurable impact
- What you built or led, with numbers someone else can check: users served, costs cut, safety incidents reduced, output increased.
- Internal reports, dashboards or client documents that confirm the results.
Adoption by others
- Contracts, licensing, deployments at other organizations, government use, open-source usage or downloads, standards that include your work.
Patents, products and technical contributions
- Patents with evidence they are used or licensed. A patent alone shows novelty, not impact.
- Products or features you designed, with launch and usage evidence.
Leadership and recognition
- Roles where you directed work with wider effects, awards from industry bodies, invitations to speak or review.
Independent corroboration
- Letters from people outside your team or company who used your work and can describe specifically how.
- Media coverage of your work or your company's results.
Show the proposed endeavor clearly
Without a publication record, a clear description of the endeavor carries more weight. Say what you will do next in the United States, for whom, how you will do it and how progress will be measured. For founders, include a business plan, evidence of funding or customer interest, and a realistic timeline. Prong 2 then asks whether your past record and your plan make you well positioned to carry it out.
Organize it so the officer can follow
- Open with EB-2 eligibility: degree, evaluation and experience letters.
- Then one section per prong, each with its own exhibits.
- Use an index with exhibit numbers, short descriptions and page numbers.
- Put the strongest, most independent evidence first in each section.
- Leave out routine documents that do not support a prong, such as every performance review you have ever had.

Frequently asked questions
Can I get an NIW without publications?
Publications are not required. You must still show EB-2 eligibility and the three Dhanasar prongs, so other evidence such as measurable project results, adoption of your work and independent letters has to carry the case.
Do I need a PhD for an EB-2 NIW?
No. A master's degree, a bachelor's plus five years of progressive experience, or exceptional ability can satisfy the EB-2 part. The waiver still depends on the three prongs.
Is a high salary evidence of national importance?
Not by itself. Salary shows professional success. National importance looks at the broader effects of your proposed endeavor.
