What USCIS asks for

Under 8 CFR 103.2(b)(3), a document in a foreign language that you send to USCIS must come with a full English translation. The translator must certify that the translation is complete and accurate, and that they are competent to translate from that language into English.

The rule applies to every kind of filing, including marriage cases, EB-2 NIW and EB-1A petitions, and responses to a Request for Evidence.

How to use the statement

Print the statement, then have the translator sign and date it. Keep it together with the English translation and a copy of the original document, so a reviewer can see all three at once.

The rule names a certification of competence and accuracy. It does not name a required credential. Check the instructions for your form, and if you are not sure who should translate, ask the person helping with your case.

Frequently asked questions

Does a translation for USCIS need to be notarized?

The regulation asks for the translator's certification, not a notary. Check the instructions for your form in case they ask for anything more.

Do I have to translate the whole document?

The regulation asks for a full English translation of the document.

Does this work for an NIW, EB-1A or RFE filing?

Yes. The same translation rule applies to petitions, applications and responses to a Request for Evidence.

Is my information sent anywhere?

No. The statement is built in your browser and is not sent or saved anywhere.
