The main risk

If you leave the United States while your I-485 is pending, USCIS may treat the application as abandoned, unless you first got advance parole. Advance parole is a travel document you request on Form I-131.

The H-1B and L-1 exception

Some people may travel without advance parole. This includes certain H-1B and L-1 workers, and their H-4 and L-2 family members, who keep that status and return to resume it, with a valid visa. The exact conditions are in the regulation linked below. If your status expires while you are abroad, the exception may not protect you.

Is a work permit enough to travel?

Not by itself. A work permit (EAD) lets you work. It is not a travel document, unless the card says it is also valid as advance parole. Some cards do.

Does advance parole guarantee reentry?

No. Advance parole lets you ask to be paroled back in at the port of entry. Officers still decide. Past immigration problems, like time without status, can matter.

Before you book a trip

  • Check your current status and whether the H-1B or L-1 exception applies to you.
  • If you need advance parole, wait until it is approved and in your hands.
  • Check for any upcoming interview or biometrics appointment. Missing one can cause problems.
  • If anything is unclear, talk to an immigration attorney before you leave.
