NIW RFE for National Importance: Why Prong 1 Matters

Español简体中文Tiếng Việt

A proposed endeavor can have substantial merit without automatically showing national importance. USCIS explains that the NIW analysis focuses on the specific proposed endeavor and its prospective impact, considered in the applicant's circumstances.

An important field is not the whole argument

Artificial intelligence, health care, infrastructure, cybersecurity, energy and manufacturing can all involve work with substantial merit. But describing the field alone does not explain what the applicant will do or why the proposed work could have broader implications for the United States.

Questions the record should answer

The right evidence depends on the endeavor. USCIS policy guidance discusses evidence such as business plans, letters of support, investments, revenue or job creation, and the applicant's education, experience and skills. No single document proves national importance in every case.

What an RFE does and does not mean

An RFE means USCIS is asking for evidence or clarification before deciding the request. It is not a denial. Read the notice itself, answer each request, and use the deadline printed on the notice. General online examples cannot replace the instructions in an individual RFE.

A strong NIW packet connects the proposed endeavor to its prospective impact instead of asking the officer to infer that connection from the importance of an industry.
